1. Agreement to Terms

By providing your mobile phone number and opting in to receive SMS (text) messages from Leron Homes & Pools INC ("we," "us," or "our"), you agree to these SMS Terms and Conditions ("Terms") and our SMS Privacy Policy.

These Terms govern your use of our SMS messaging service and constitute a legally binding agreement between you and Leron Homes & Pools INC.

2. SMS Program Description

Our SMS program allows you to receive:

• Pool design quotes and project estimates
• Appointment reminders and confirmations
• Construction updates and notifications
• Customer support messages
• Promotional offers and special deals (if you opt in)
• General service information

Program Summary and Key Disclosures

• You can cancel the SMS service at any time. Simply text "STOP" to our number. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially. If you experience issues with the messaging program, reply with the keyword "HELP" for more assistance, or reach out directly to sales@leronhomes.com or call (407) 385-3291. Carriers are not liable for delayed or undelivered messages. As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency may vary (up to 10 messages per month). For questions about your text or data plan, contact your wireless provider. 3. Consent and Opt-In

By checking the consent box and providing your phone number, you:

• Expressly consent to receive automated SMS messages
• Confirm that you are the account holder or authorized user
• Agree to receive messages at the number provided

Message frequency may vary depending on:

You may receive up to approximately 10 messages per month. During active construction periods or promotional events, frequency may increase.

Message and data rates may apply. Standard text messaging rates from your mobile carrier will apply to all SMS messages sent and received. We do not charge for SMS messages, but your carrier may charge you for:

• Incoming text messages
• Outgoing text messages (e.g., STOP, HELP)
• Data usage associated with text messages

Check with your mobile carrier for details about your messaging plan and rates.

Our SMS service is available on major U.S. carriers, including but not limited to:

• T-Mobile
• Verizon
• Sprint
• Boost Mobile
• Cricket Wireless

• Virgin Mobile

Carriers are not liable for delayed or undelivered messages.

7. How to Opt-Out (Unsubscribe)

You can stop receiving SMS messages at any time by:

• Text STOP: Reply with STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message

After you opt-out, you will receive one final confirmation message. You may receive messages for a short period while we process your request.

Note: Opting out of SMS messages does not affect your ability to use our services. You can still contact us via phone, email, or our website.

Our total liability shall not exceed the amount paid by you for services in the three months preceding the claim.

You agree to indemnify, defend, and hold harmless Leron Homes & Pools INC, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including attorney's fees) arising from:

• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws

18. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the SMS service shall be resolved through:

• Good faith negotiation between the parties
• Mediation in Orange County, Florida (if negotiation fails)
• Binding arbitration in Orange County, Florida (if mediation fails)

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with our SMS Privacy Policy, constitute the entire agreement between you and Leron Homes & Pools INC regarding the SMS service and supersede any prior agreements.
